Terms of Service

These Terms of Service ("Terms") govern your use of the Ember Audio mobile application (the "App") operated by Hermitage Studios LLC ("we," "us," or "our"). By using the App, you agree to these Terms.

Account Registration

To use Ember Audio, you must create an account using a valid email address, Google Sign-In, or Sign in with Apple. You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration and keep your account information up to date.

Acceptable Use

You agree to use the App only for its intended purpose: recording and sharing audio narrations of books for personal and family use. You agree not to:

• Upload or share content that is harmful, abusive, or illegal
• Use the App to infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to other users' accounts or data
• Use the App for any commercial purpose not authorized by us
• Interfere with or disrupt the App's services or infrastructure

User Content

You retain ownership of all audio recordings and content you create using the App. By sharing recordings through the family sharing feature, you grant us a limited license to store and transmit that content to the family members you designate. We do not claim ownership of your recordings and will not use them for any purpose other than providing the App's services to you.

Subscriptions and Payments

Ember Audio offers optional premium subscriptions that unlock additional features including family sharing. Subscriptions are billed through your Apple ID account.

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage and cancel subscriptions in your device's Settings under Apple ID > Subscriptions
• No refunds are provided for partial subscription periods. Refund requests should be directed to Apple.

Referral Program

Ember Audio may offer a referral program that provides temporary premium access when new users sign up using your referral code. We reserve the right to modify or discontinue the referral program at any time. Abuse of the referral system, including creating fake accounts, may result in revocation of referral benefits or account termination.

Intellectual Property

The App, including its design, features, and underlying technology, is owned by Hermitage Studios LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for the loss of any recordings or data, and we recommend keeping local backups of important content.

Limitation of Liability

To the maximum extent permitted by law, Hermitage Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App's subscription in the twelve months preceding the claim.

Account Termination

You may delete your account at any time from within the App. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the App ceases and we may delete your account data in accordance with our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the App after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in accordance with applicable law.
